Conditions & Terms

1.1 These General Terms and Conditions, in the version valid at the time of the order, govern all orders and deliveries and the associated purchase contracts via the website www.soelva.com
1.2 The buyer is the natural and legal person who places the order. By placing the order, the Buyer declares that he/she has full legal capacity and that the personal data provided by him/her is correct. 1.3 The seller is the company Weingut Peter Sölva with registered office at Goldgasse 33, 39052 Kaltern, Italy, registered in the Bolzano Commercial Register with number and VAT number.

2 Conclusion of contract
2.1 The buyer's order constitutes a binding offer to conclude a purchase contract for the ordered goods 2.2 A purchase contract is only concluded with the express acceptance of the order by the seller Weingut Peter Sölva by sending a corresponding order confirmation by e-mail or implied by the delivery of the ordered goods.

3 Prices
3.1 The prices shown in the online shop at the time of ordering shall apply. Weingut Peter Sölva reserves the right to change prices without prior notice. 3.2 Unless expressly agreed otherwise in writing, the prices include statutory VAT, plus any shipping costs incurred and any packaging costs incurred in the case of gift packages, special compilations and the like.

4 Minimum order quantity and shipping costs
4.1 The minimum order quantity is 120 euros (including VAT, excluding shipping costs and, if applicable, packaging costs in accordance with section 3.2 above)
4.2 Depending on the number of bottles, the shipping costs to be borne by the buyer will be charged per order for the dispatch of the goods to the countries listed in the parcel service or in groupage freight.

5 Delivery and risk
5.1 Unless otherwise agreed in writing, the goods shall be delivered to the delivery address specified by the buyer after receipt of full payment.
5.2 Any information on delivery dates shall always be non-binding, unless Weingut Peter Sölva expressly agrees a binding delivery date in writing.
5.3 Delivery may also be made in several instalments at the discretion of Weingut Peter Sölva.
5.4 In the event of total or partial unavailability of the goods, there is no obligation to deliver. In this case, the buyer will be informed by e-mail. Payments already received will be refunded.
5.5 The risk shall pass to the buyer as soon as the goods are handed over to the first carrier for transmission to the buyer. This also applies in the case of partial deliveries.
5.6 We do not deliver to PACK stations.

6 Payment and retention of title
6.1 Payment of the full price (including shipping costs and, if applicable, packaging costs) is due upon receipt of the order. The place of fulfilment for payment is Kaltern (BZ), Italy.
6.2 Payment of the price can be made by: a) bank transfer stating the order number and free of charge for the recipient b) PayPal
6.3 If the goods are not or not fully paid for after order confirmation for whatever reason and the goods are nevertheless delivered at our discretion, the goods remain the property of Weingut Peter Sölva until full payment has been received.
6.4 Should a third party seize the goods in the context of foreclosure or insolvency proceedings or other proceedings or should the goods be exposed to other interventions by third parties, the buyer must inform this third party of the ownership rights of Weingut Peter Sölva, inform him of this immediately and provide all support to protect the rights and interests.

7. right of cancellation for consumers
7.1 The buyer who is a consumer within the meaning of the Italian Civil Code. GvD. No. 206/2005 (the "Consumer Code") may, pursuant to art. 64 et seq. Consumer Code, may withdraw from the purchase contract within a period of 10 (ten) working days from receipt of the goods. The notice of cancellation shall be sent in writing by registered letter with acknowledgement of receipt to Weingut Peter Sölva. The declaration of cancellation may also be made by e-mail (www.soelva.com) within the aforementioned period if the cancellation is confirmed within the following 48 (eight and forty) hours by registered letter with acknowledgement of receipt.
7.2 The refund of the price will be made after the return of the goods, which must be returned within 10 (ten) days from the exercise of the right of withdrawal at your own expense.
7.3 The right of cancellation is excluded if the goods are damaged, no longer in their original packaging, impaired by signs of use or incomplete.

8 Warranty and liability
8.1 The production images do not correspond to the appearance of the delivered goods.
8.2 The liability of Weingut Peter Sölva is limited to intent and gross negligence. Weingut Peter Sölva shall in no case be responsible for the lack of or inadequate performance if this was caused by force majeure.
8.3 Obvious transport damage must be claimed by the buyer directly from the carrier.

9. data protection
9.1 The data protection notice of Weingut Peter Sölva in accordance with GDPR can be found in the online shop itself and the buyer declares to have taken note of it.

10 Legal venue and jurisdiction
10.1 These GTCs. And the entire legal relationship between the parties shall be governed by the law of the Republic of Italy to the exclusion of private international law.
10.2 If the buyer is not a consumer within the meaning of consumer protection law, Bolzano (Italy) shall be the exclusive place of jurisdiction for all disputes arising from or in connection with contracts between Weingut Peter Sölva and the buyer.

11. final provision
11.1 Should individual provisions of these GTC be or become invalid in whole or in part, the remaining provisions shall remain unaffected.
11.2 The purchaser may not assign claims against Weingut Peter Sölva.
11.3 Collateral agreements, amendments and supplements to these GTC must be made in writing.
11.4 The German version of these GTC shall prevail.
